TERMS OF SERVICE

User responsibilities:  Acceptance of terms and conditions: The terms and conditions are the terms on which cpap-auctions.com offers you access to the services and the web site. By registering as a member of CPAP-Auctions you accept these terms and conditions.   If you are a user of our Services, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the cpap-auctions.com registration forms (b) maintain and promptly update information regarding the location and contact information for your business. If you do not accept these terms and conditions, you are not allowed to use our services. 

Any violation of these terms of service may result in termination of your account.   It is our policy that the buyer and seller must contact each other within 48 hours of notification of an Arrange to buy request to make final closing arrangements. 

 CPAP- Auctions.com is an electronic medium in which buyers and sellers of medical equipment interact.  It is the responsibility of the buyer to insure that the medical products they have purchased useing cpap-auctions are properly cleaned before using them. It the responsibility of the seller and the buyer not to violate any federal and state laws by buying or selling products that require a prescription., It is the seller’s responsibility to comply with all federal and state laws regulating the sale of CPAP, BIPAP, Oximeters Nebulizers and other Products that require a prescription. 

 Please be advised that individuals who are not legally qualified under federal or state guidelines to sell their used CPAP/medical equipment can sell their equipment to a licensed DME dealer on the Auction site.  

CPAP-AUCTIONS.COM is not involved in the actual transaction between the buyer, seller, or intermediary.  We do not guarantee, or warranty the truth, accuracy, legality, quality, or safety of the listed items.  It is recommended that you obtain a safety inspection by a third party for the accuracy and safety of any medical products before or after arrival to your home, or place of business.  The services of one of our DME sponsors would be appropriate if they offer such services.

 These terms and conditions may be changed in whole or in part by CPAP-Auctions at any time.  Amendments will be effective immediately upon posting of the amended terms and conditions on CPAP-auctions.com.  

Liability: You are responsible for ensuring you are in compliance with the latest terms and conditions. Your continued use of the services represents your agreement to be bound by the terms and conditions as amended.  We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, cleanliness, safety or legality of items advertised, the truth or accuracy of listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.  Regardless of our liability policies, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) not to exceed $100.00. 

Laws: These Terms of Service shall be governed by and constructed in accordance with the laws of The United States of America and any disputes will be decided only by the Courts of the United States of America.  We do not transfer legal ownership of items from the seller to the buyer, nothing in this agreement can modify the governing laws of the federal, or state governments of the United States of America. Conduct: You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you are entitled to sell or buy the relevant item and that you are not prohibited from doing so by any federal, state or any law or regulation.
